The judge has ruled that the Bushmen have no right of access to a pool of water on their land, or digging a new well within the Game Reserve, Central Kalahari, one of the driest regions of the world. The case hearing was held on June 9, but the court reserved its verdict on 21.

The ruling is a blow for the Bushmen, who have had serious difficulties without water since 2002 when the Botswana government sealed and plugged a hole to force them to leave the reserve. In 2006, the Supreme Court declared unconstitutional, illegal and forced evictions of the Bushmen, and since then hundreds have returned to their land.

Despite the verdict, the government banned the Bushmen to bring the well back up and running, letting it faced what the highest representative of United Nations Indigenous Peoples, James Anaya, described as "harsh and dangerous conditions due to lack of access to water." At the same time, Wilderness Safaris Bushman territory opened in luxury accommodation for tourists with a bar and pool, and the government dug new wells inside the reserve to provide wild animals with funding from Tiffany & Co. "They are very bad news. If you do not have water, how do you want to live? The Court gave us our land, but without Well, without water, our lives are difficult, "Jumanda Gakelebone, spokesman Bushman.

After the verdict, internal sources to Survival International said: "In the last ten years Botswana has become one of the toughest areas around the world for indigenous peoples. If the Bushmen denied water in their own lands, while tourists, animals and the diamond mines it is freely available, foreigners should ask themselves if they really want to support this scheme with their views and jewelry purchases.
